Where can I build my pool? Pools must be built within the accessory structure setback for your zoning district. Pools may not be built in the Lake Norman Watershed Buffer. Pools must be located at least:
- 50 ft. from any water supply source.
- 100 ft. from any private water supply source.
- 15 ft. from any septic system.

What are the specifications for barriers? Effective barriers are necessary to prevent unauthorized access to the pool. Pool must be enclosed such that:
- A 44 inch minimum height is provided around the entire swimming pool.
- Any openings in the enclosure cannot exceed 4 inches.
- All gates and doors should be self closing and capable of being locked.
- The wall of an above ground swimming pool can be considered an effective barrier when it is at least 44 inches and can be closed to access when not in use.
- Enclosure should be complete when pool is allowed to contain water.

What are the regulations regarding operation and maintenance? At the end of swimming season the pool must be maintained to prevent unsanitary conditions. Pools under construction or no longer being operated shall be maintained to prevent unsanitary conditions, danger of injury or drowning. Wastewater from the pool shall be discharged in a sanitary sewer.

Do these requirements apply to existing pools? Pools constructed after May 18, 1999 must comply fully with the restrictions. Pools that are permitted and are existing or already under construction do not have to be modified unless they create a public health hazard.

Who imposes restrictions for residential pools? The Mecklenburg County Board of Commissioners acting as the Board of Health imposes restrictions for residential swimming pools.

How do I obtain a permit? You can obtain a Mecklenburg County Building Permit application at the Town of Cornelius Planning Department. Cornelius Planning Staff must approve the zoning and collect the Cornelius permit fee. You will then submit the permit application to Mecklenburg County who will issue the permit. In addition to the building permit, Mecklenburg County requires:
- A site plan showing proposed pool dimensions and barrier locations as well as existing structures, septic systems and wells.
- Specifications of wastewater disposal.
- Specifications of water supply for pool.
- Inspection upon completion of construction.
- Inspection prior to construction if the location is near an existing or proposed septic system.
No person shall construct, install, or modify a residential swimming pool without a permit.
